SmithKline Beecham began testing on the drug in 1999 to see how it compared to a rival pill, the Takeda-manufactured Actos. The results showed signs that Avandia posed a heart risk.

In a March 29, 2001 e-mail about the study, SmithKline executive Dr. Martin I. Freed wrote: “This was done for the U.S. business, way under the radar. Per Sr. Mgmt request, these data should not see the light of day to anyone outside of GSK.” The company became GlaxoSmithKline after a 2000 merger.

The fact that this drug maker tried to hide the facts from consumers, doctors and the Government is deplorable.
Think about it. Glaxo created a diabetes drug that, at its high point, was raking in more than $3 billion a year in profits. Glaxo spent millions of dollars for research and development of the drug, paid for the clinical trials, and purchased approval from the FDA for the several million dollars it costs to complete the FDA drug application. And GSK did all this knowing full well that the drug causes a substantial increase in the risk of heart attacks and death.

South Carolina files Fraud Lawsuit against Avandia

GlaxoSmithKline, the distributor of the diabetes drug, Avandia, is facing a lawsuit filed by South Carolina officials in May. Officials state that there was a failure to warn consumers of Avandia heart attack risks and other serious side effects after using Avandia. The drug has been removed from the shelves of many countries and now is heavily restricted in the US.

The Attorney General of South Carolina filed the lawsuit on May 17 after months of alleged defrauded reimbursement programs which helped increase the number of Avandia prescriptions.

The lawsuit is primarily based on the claim that Glaxo used illegal marketing tactics, failing to notify of possible risks while simultaneously exaggerating the effectiveness of Avandia.

South Carolina officials allege that GlaxoSmithKline essentially convinced the state that the drug was effective and safe, while cheating tax payers out of millions. The lawsuit looks to reclaim $5,000 for every violation of the Unfair Trade Practices Act, as well as $2,000 for every Avandia Medicaid claim reimbursed by the state.

Just last month, the FDA limited the availability of Avandia to certain pharmacies. The huge review of Medicare records, came two weeks ahead of a FDA hearing on Avandia’s safety. The lead author, Dr. David Graham, is an FDA scientist who wants the drug banned.

As many as 100,000 Avandia heart attacks, strokes, deaths and cases of heart failure may be due to Avandia since it came on the market in 1999, Graham said in an interview with The Associated Press.

Harms from Avandia are great enough to “put you in a hospital or in a cemetery,” he said.

South Africa has joined the growing list of countries who have recalled the diabetes drug Avandia due to the risk of heart problems and death, although the medication remains available in the United States with severe restrictions on who can receive the drug. 

Earlier this month South Africa’s Medicines Control Council (MCC) withdrew permission for GlaxoSmithKline to market Avandia in that country. Glaxo officials said they have been notified of the decision and decided not to appeal it.

The MCC is not allowed to discuss its decision until it receives official recognition of notification from the manufacturer, officials have said. However, the Avandia recall in South Africa was after similar decisions were reached in other countries due to concerns about an increased risk of heart attacks and congestive heart failure from Avandia side effects.

Avandia Recall

Avandia (rosiglitazone) was first introduced in 1998 to treat type 2 diabetes by helping control blood sugar levels. The drug has been used by millions of diabetics throughout the world, but sales began to plummet in mid-2007, after potential Avandia heart risks were highlighted in a study published by the New England Journal of Medicine.

A “black box” warning was added to Avandia in the United States in November 2007, but many critics continued to argue that the warning was not strong enough and called for an Avandia recall to be issued in the United States.

Despite heated internal debate, the FDA decided in September 2010 not to issue an Avandia Recall in the United States, allowing the medication to remain on the market with severe restrictions on who can use the product.

The agency determined that only patients who have failed to control their diabetes through every other available medication should be given access to the medication, and ordered the drug’s maker, GlaxoSmithKline, to develop a risk evaluation and mitigation strategy (REMS) to make sure the drug is adequately restricted.

GlaxoSmithKline has faced thousands of Avandia lawsuits in the U.S. filed by people who allege that the drug maker failed to adequately warn about the risk of heart problems from Avandia.
